By placing an order you agree to the Terms of Service set forth below as they may be updated from time to time by Scappywood.com ("Scrappywood"). Scrappywood may modify the Services from time to time, for any reason, and without notice.
I. Description of the Services
Scrappywood provides users with the ability to submit photos for video editing. Accordingly, you grant Scrappywood the right to edit, modify, and crop content as necessary to perform our services to you. You are solely responsible for any fees, charges and expenses. You must be 18 years or older to use our services.
II. Scrappywood Unsolicited Idea Submission Policy
Scrappywood does not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new or improved products or technologies, product enhancements, processes, materials, marketing plans or new product names. Please do not send any original creative artwork, suggestions or other works. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Scrappywood’s products or marketing strategies might seem similar to ideas submitted to us. So, please do not send your unsolicited ideas to Scrappywood or anyone at Scrappywood. If, despite our request that you not send us your ideas, you still send them, then regardless of what your letter says, the following terms shall apply to your idea submission.
Terms of Idea Submission
You agree that: (1) your ideas will automatically become the property of Scrappywood, without compensation to you, and (2) Scrappywood can use the ideas for any purpose and in any way, even give them to others.
III. Trademarks and Copyrights
All intellectual property used in conjunction with the products offered by Scrappywood shall be the property of Scrappywood. Scrappywood shall be the owner of all copyright, and database rights, and any other intellectual property rights. You may not publish, distribute, extract, or reproduce any such content in any material form.
Scrappywood respects the intellectual property of others and we ask that our users do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, please notify Scrappywood and provide the following information:
1. An electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
2. A detailed description of of the copyrighted work that you claim has been infringed.
3. A description of where the material that you claim is infringing is located on the site.
4. Your address, telephone number and e-mail address.
5. A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or any applicable law.

Scrappywood expressly disclaims any responsibility or liability for the use of the Services by you. Scrappywood also disclaims any and all responsibility or liability for:

UNDER NO CIRCUMSTANCES SHALL SCRAPPYWOOD BE LIABLE TO YOU FOR THE MISUSE OF AND OR RELIANCE ON SERVICES. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES. SUCH LIMITATION OF LIABILITY SHALL APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE ON THE SERVICES.

VI. Indemnification
You agree to defend, idemnify, and hold harmless Scrappywood and its subsidiaries and other affiliated companies, and their employees, officers, directors, contractors, agents, licensors, and suppliers, from all liabilities, losses, damages, claims, costs and expenses, including reasonable attorney's fees, that arise from (i) use or misuse of the Services, (ii) your violation of any of these Terms of Service, or (iii) any other activity related to your account (including negligent or wrongful conduct). Scrappywood reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to defense by you, in which event you will cooperate with Scrappywood and its counsel in the conduct of such defense.
VII. Forum and Choice of Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Service or your use of the services provided by Scrappywood shall be filed only in the state courts located in the State of California and in the county of Orange and you further agree and submit to the exercise of personal jurisdiction of such courts or the purpose of litigating any such claim or action. You agree that regardless of any statute or law to the contrary, any claim or cause of action must be filed within 90 days after such claim or cause of action arose otherwise any claims or causes of action shall be forever barred.
VIII. Entire Agreement
These Terms of Service constitute the entire agreement between you, the User, and Scrappywood with respect to the subject matter contained herein and supersedes any other agreement, proposals and communications, written or oral, between Scrappywood and you. If a court should find that one or more rights or provisions contained in these Terms of Service are invalid, you agree that the remainder of the Terms of Service shall be enforceable.
Return and Refund Policy
No monetary refunds will be honored. In the case that you receive a damaged or defected DVD we will happily send you a replacement DVD at no cost. DVD's damaged by abnormal wear and tear, scratches, etc. will not be replaced.

Scrappywood is committed to protecting your privacy when you visit Scrappywood.com (“Site”) or use its services ("Services") as further outlined in this policy. As a condition of using the Services of Scrappywood.com, you agree to provide Scrappywood.com with certain personal information.
